This document is an electronic record in terms of the Information Technology Act, 2000 and the applicable rules thereunder, including amended provisions relating to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, which require publishing the rules, regulations, privacy policy, and terms of use for access or usage of the website https://collably.fastvalue.in and any related mobile site, application, or platform (collectively referred to as the “Platform”).

The Platform is owned and operated by Fast Value Technologies LLP (hereinafter referred to as “Fast Value”, “Platform Owner”, “we”, “us”, or “our”), having its registered office at S402, Celestial City, Phase 1, S N 78/86, Ravet, Pune - 412101, Maharashtra, India.

Your use of the Platform, products, services, tools, subscriptions, and related offerings (collectively, the “Services”) is governed by these Terms of Use, together with all policies referenced herein, including the Privacy Policy. By accessing, browsing, registering on, or using the Platform, you agree to be bound by these Terms of Use and all applicable policies.

For the purposes of these Terms of Use, “you”, “your”, or “user” means any natural person, legal entity, organization, business, or representative accessing or using the Platform.

ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL TERMS AND CONDITIONS CONTAINED HEREIN. IF YOU DO NOT AGREE WITH THESE TERMS, PLEASE DO NOT USE THE PLATFORM.

• You agree to provide true, accurate, current, and complete information during registration and while using the Platform.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.
• You agree to use the Platform only for lawful purposes and in compliance with applicable laws and regulations.
• You shall not misuse, interfere with, disrupt, reverse engineer, copy, reproduce, distribute, or exploit any part of the Platform except as expressly permitted by law.

• Certain Services are offered on a paid subscription basis. By purchasing a subscription, you agree to pay all applicable fees, taxes, and charges associated with the selected plan.
• Subscription pricing may vary by country, currency, or region and may be updated from time to time.
• Continued use of paid Services is subject to successful payment processing.
• Payment Security: All payments are processed through secure, RBI-approved Payment Aggregators. In compliance with RBI guidelines, we do not save any debit/credit card numbers, UPI PINs, or bank account passwords on our servers.

• As Collably is a digital application and software service, no physical shipping or delivery applies.
• Fulfillment Timeline: Upon successful processing and confirmation of your payment by our payment gateway, access to the Services will be activated immediately. However, in case of technical issues, the access to the Services will be resolved within 3 working days.
• Confirmation of your subscription and digital invoice will be sent to your registered email address within 24 hours.

• You may cancel your subscription at any time through the Platform or by contacting support.
• Cancellation prevents future renewals but does not immediately terminate access to Services already paid for. The account and features you had subscribed to will remain fully active till the end of the subscribed period.
• Data Access: During the active subscription period following cancellation, you may continue using the Services. Upon expiration of the subscribed period, you will lose direct access to the Platform and your data. Automated data export functionality is not available directly on the Platform; data export requests must be submitted directly to our support team.
• No Refunds: As the Platform provides immediate access to digital tools and services, no refunds shall be provided for subscription fees already paid, except in specific cases of duplicate processing or where access to the Services is not provided as per the terms of use. Taxes, payment processing charges, and any related fees are strictly non-refundable.
• Partial refunds, prorated refunds, or credits for unused subscription periods will not be provided.

The Platform, including its design, layout, software, content, trademarks, logos, graphics, text, and functionality, is owned by or licensed to Fast Value and is protected under applicable intellectual property laws.

Nothing contained in these Terms grants you any ownership rights in the Platform or its contents.

The Platform may contain links to third-party websites, services, integrations, or resources. Such third-party services are governed by their own terms and privacy policies. Fast Value shall not be responsible for the content, availability, or practices of any third-party service.

Neither Fast Value nor any third party makes any warranty or representation regarding the accuracy, completeness, reliability, suitability, availability, or performance of the Platform or Services.

The Platform and Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

To the maximum extent permitted by law, Fast Value shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of the Platform or Services.

Your use of the Platform and Services is entirely at your own risk and discretion.

You agree to indemnify, defend, and hold harmless Fast Value, its affiliates, directors, officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses arising from:

• 1.Your breach of these Terms;
• 2.Your violation of applicable laws;
• 3.Your misuse of the Platform;
• 4.Your infringement of any third-party rights.

Fast Value shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, internet failures, governmental actions, labor disputes, or other force majeure events.

These Terms shall be governed by and construed in accordance with the laws of India.

Any dispute arising out of or relating to these Terms, the Platform, or the Services shall be subject to the exclusive jurisdiction of the competent courts located in Pune, Maharashtra, India.
